Operator: Xenyyo Inc. ("OnlyHugs", "we", "us"), a Delaware corporation.
These Terms govern your use of onlyhugs.help (the "Service"). By using the Service you agree to them. If you don't agree, don't use the Service. We know. Terms.
1. What OnlyHugs is
OnlyHugs is a parody platform. People ("Huggers") post stories about real people in their lives who could use a hug ("Huggees"). Other people ("Helpers") contribute money to those stories. The Hugger delivers the hug in real life. That's the whole product.
To be clear about what you are and aren't getting:
- A contribution is a voluntary payment to reward a story. It is not a purchase of goods, services, content, or a guaranteed hug. Helpers receive nothing tangible in return.
- We don't verify, witness, or evidence hug delivery. Delivery runs on the honor system. "Verified" on the Service means only that a Hugger's payout account has been verified by Stripe, our payment processor. It does not mean we verified the story, the photo, the Huggee, or that any hug happened.
- We are not a charity or a fundraising platform and contributions are not tax-deductible.
2. Eligibility
You must be at least 18 years old to use the Service. Huggees must also be at least 18 years old. Stories or photos featuring anyone under 18 are not allowed and will be removed.
3. Accounts
You don't need an account to contribute. You need one to post a Hug Story or to keep a record of the hugs you funded. You can sign in with email and password, Google, or an emailed login link. One account per email. Keep your credentials to yourself; you're responsible for what happens under your account. Hugger aliases are permanent once chosen.
4. Hug Stories and content
When you post a Hug Story (name, situation, story text, photo, urgency), you represent and warrant that:
- you own the photo or have the right to use it, and
- the Huggee is a real person who is 18 or older and who has consented to being featured on the Service, including their photo and the details you share, and
- the content is accurate, not defamatory, and not intended to harass, humiliate, or deceive anyone.
Prohibited content: sexual or suggestive content; nudity; violence or gore; anyone under 18; content that infringes someone else's copyright, trademark, or right of publicity; hate speech; harassment; spam; anything illegal. Photos are screened automatically at upload and may be rejected. Stories may also be reported by anyone and reviewed by a human.
Our rights: we may remove, hide, or edit any story, and suspend or terminate any account, at any time, with or without notice, if we believe these Terms are being violated or the content creates risk for anyone. We may withhold, reverse, or refund funds connected to removed content or terminated accounts.
License: you keep ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and share your story and photo on the Service and in previews of it (for example, link previews when someone shares a story). Story pages are public, including the photo.
Takedowns and disputes: if you appear in a story and did not consent, or want it removed, email hello@onlyhugs.help. We remove such content promptly.
5. Contributions (Helpers)
- Contributions are processed by Stripe. We don't store card numbers. Stripe's own terms apply to the payment.
- Contributions are voluntary and non-refundable, except where required by law or at our sole discretion. Because you are rewarding a story and not buying delivery of a hug, non-delivery of a hug is not grounds for a refund.
- Amounts are in US dollars. Hug tiers ($1, $3, $5) are labels for contribution amounts, not products.
- If you dispute a charge with your bank, we may reverse any related payout to the Hugger and may suspend the accounts involved.
- You may contribute as a guest. Stripe still asks for your email so we can send your receipt, but guest contributions are not linked to any OnlyHugs account, and they will not appear in an account you create later with the same email.
6. Payouts (Huggers)
- Payouts are made through Stripe Connect. To receive money you must complete Stripe's onboarding and verification. We don't control Stripe's requirements or timing.
- For every contribution, Stripe's processing fee is deducted first; the Hugger receives 85% of what remains and OnlyHugs keeps 15% as a platform fee. Fees may vary by payment method; the split always uses the actual fee charged.
- Contributions to a Hugger who has not completed Stripe verification are held on the Hugger's behalf until verification completes. There is no deadline to verify.
- Payouts are sent once a Hugger's accumulated balance reaches US$10. Smaller balances are held on the Hugger's behalf until then.
- If a Hugger's account shows no payout activity for 12 months, we may classify the held balance as dormant, attempt to contact the Hugger at their account email, and thereafter treat the balance as unclaimed property in accordance with applicable law. We do not keep dormant balances for ourselves.
- You are responsible for any taxes on money you receive. Stripe may issue tax forms where required.
- We may delay, withhold, or reverse payouts in cases of fraud, disputes, refunds, chargebacks, legal requests, or violations of these Terms.
7. Delivering the hugs
Funded hugs are owed hugs. Huggers agree to deliver them to the Huggee in person, with consent, and in a manner that is lawful and appropriate. The Service provides a delivery counter so Huggers can record what they've delivered; it is self-reported and we don't verify it.
8. Intellectual property
The OnlyHugs name, wordmark, design, and copy belong to Xenyyo Inc. The Service is a parody; nothing on it is affiliated with, endorsed by, or connected to any other platform whose style it references.
Copyright complaints (DMCA): if you believe content on the Service infringes your copyright, send a notice to our designated agent at hello@onlyhugs.help or by mail to Xenyyo Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, United States, including: your contact details, identification of the work, the URL of the infringing content, a statement of good-faith belief, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. We respond to valid notices by removing or disabling the content and may terminate repeat infringers.
9. Prohibited uses
Don't: use the Service for anything illegal; post content about people without their consent; impersonate anyone; scrape or bulk-download content; interfere with the Service's operation or security; use automated tools to post or contribute; circumvent moderation or rate limits; or use the Service to launder money or process payments for anything other than rewarding Hug Stories.
10. Disclaimers
The Service is provided "as is" and "as available." We make no warranties of any kind, express or implied, including that the Service will be uninterrupted or error-free, that stories or photos are accurate or authorized, or that any hug will be delivered. We don't verify identities, stories, photos, or delivery. Any interactions between Huggers, Huggees, and Helpers happen entirely at their own risk.
11. Limitation of liability
To the fullest extent permitted by law, Xenyyo Inc. and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amounts you paid us as platform fees in the 12 months before the claim or US$100.
12. Indemnification
You agree to indemnify and hold harmless Xenyyo Inc. from any claims, damages, and expenses (including reasonable legal fees) arising from content you post, your violation of these Terms, or your violation of anyone's rights, including a Huggee's right of publicity or privacy.
13. Termination
You may stop using the Service at any time; email hello@onlyhugs.help to delete your account. We may suspend or terminate your access at any time for violating these Terms. Sections 5, 6 (as to held funds), 8, 10, 11, 12, and 15 survive termination.
14. Changes
We may update these Terms. Material changes will be announced on the Service or by email to account holders, with the new effective date at the top. Continued use after the effective date means you accept the changes.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction.
